Micron Is Paying $600 Million to Settle a $445 Million Verdict
A jury handed Netlist a $445 million win against Micron, but collecting that money was another battle entirely. What Netlist ultimately accepted, and why Micron agreed to pay even more, reveals how high the stakes had quietly become.
Micron Technology (NASDAQ:MU | MU Price Prediction) agreed on October 5, 2026, to pay Netlist (OTC:NLST) $600 million over five years. That is more than the $445 million jury verdict at the center of their patent fight.
Micron never paid the verdict and was still appealing, so the settlement gives Netlist cash it couldn’t collect.
Why Micron Paid More Than the Verdict
A Texas jury found in May 2024 that Micron’s memory modules infringed two Netlist patents, awarding $425 million on one and $20 million on the other. The Patent Trial and Appeal Board later ruled the asserted claims of both unpatentable, and Micron filed notice of appeal in July 2025.
The settlement, announced October 6, releases all pending proceedings and voids the verdict. Micron also gets a five-year license to Netlist’s worldwide portfolio, covering patents an appeal could never reach.
This matters because Netlist asked the International Trade Commission in late September to block imports of Micron chips used in AI systems. An import ban stops product from reaching customers, whereas damages only cost money.
Small Payments for Micron Mean Big Revenue for Netlist
In fiscal fourth quarter 2026, Micron posted revenue of $54.23 billion, net income of $37.70 billion, and free cash flow of $33.20 billion. Each $30 million quarterly fee equals about 0.06% of that quarter’s revenue.
Netlist’s gain reflects $120 million each year, on trailing revenue of $332.69 million.
Netlist Collects From Two Memory Giants
Netlist struck a similar deal with Samsung in August 2026, with $239 million upfront and quarterly fees of up to $32.9 million. Chief executive C.K. Hong said, “The agreement with Micron further validates the value of our AI memory technologies.”
With two licensees paying, Netlist’s income depends less on future verdicts. However, Micron fees stop in 2031, patents age, and fewer unlicensed targets remain.
Why Micron Matters More
Micron is capital-intensive and cyclical. Its 87.0% gross margin depends on tight supply, and memory cycles have turned before. Netlist’s revenue comes largely from reselling other makers’ DRAM at thin margins, so most of its value depends on licensing.
Micron has the stronger outlook of the two companies. It guided fiscal first quarter 2027 revenue to $61.5 billion, plus or minus $1.5 billion, with more than 75% of 2027 output already committed. Micron has 26 strategic customer agreements with take-or-pay volumes and $32 billion in customer commitments, which should cushion the next downturn. The main risk is oversupply once new fabs ramp in 2027 and 2028.
